ICE withheld released detainees' IDs, work permits and belongings for months, seven plaintiffs alleged in a class-action suit
Event: October 13, 2026 Location: Washington, D.C. Jurisdiction: Federal Abuses: Denial of hearing, Denial of due process in immigration enforcement
On October 13, 2026, seven people formerly held in immigration detention filed a class-action lawsuit in federal court in Washington, D.C., alleging that U.S. Immigration and Customs Enforcement has a de facto policy of not returning property it seizes from people it detains and later releases. Each plaintiff says ICE has kept items such as passports, Social Security cards, employment authorization documents, phones and a wedding band for at least five months after release, in violation of the Fourth Amendment and ICE's own written directives.
