Dear Community,
This week, we're holding space for a mix of heavy news and fierce resilience. On August 5th, the EHRC's revised Code of Practice on single-sex spaces came into force—a development that has caused real pain, confusion, and anger across our community. We want to acknowledge that weight first. If you're feeling anxious about what this means for your daily life, you are not alone, and your feelings are valid.
But here's what we also want you to know: we are not taking this lying down.
The Pushback Has Already Begun
Within hours of the Code taking effect, the Good Law Project announced a formal legal challenge against both the UK Government and the EHRC. This is not a distant hope—it is happening now. Legal experts are drawing parallels to Goodwin v. United Kingdom, the landmark case that transformed trans rights across Europe. There is a credible path for this challenge to climb through the UK Supreme Court and onward to the European Court of Human Rights.
Meanwhile, in an encouraging counterpoint, the High Court has ruled that police strip searches do not have to be strictly partitioned by biological sex. This shows that the judiciary is not monolithically aligned with the EHRC's restrictive interpretation. There are cracks in the wall, and light is getting through.
Scotland: A Quiet(ish) Source of Pride
While Westminster takes steps backward, it's worth remembering that progress is not uniform across these islands. Scotland continues to hold firmer ground on trans rights, with the Scottish Government maintaining its commitment to the Gender Recognition Reform Bill and inclusive healthcare pathways. Scottish councils and public bodies are, in many cases, signalling their intent to interpret the EHRC guidance as narrowly as possible, prioritising dignity and inclusion.
We are not a monolith, and neither is the UK. Scotland's stance is a reminder that another way is possible—and that devolved power can be a tool for protection.
Political Pressure & International Eyes
The Trans Advocacy & Campaign Collective (TACC) has begun writing to MPs, demanding the restoration of statutory protections. This is direct action, and it matters. When we show up in the inboxes of power, we become impossible to ignore.
And the world is watching. International observers, particularly in North America, are recalibrating their assumptions about the UK's "progressive" reputation. This scrutiny could translate into diplomatic pressure—and it certainly puts the UK government's human rights record under a global microscope.
