UP and CN announced two binding memoranda on 22 July 2026 tied to the proposed UP–Norfolk Southern merger, under which CN gains access at points where Class I options would fall from two to one or three to two, and agrees not to oppose the transaction [2]. BNSF objected in a 24 July 2026 customer letter, arguing the agreements do not resolve competition concerns, that the combined carrier would control roughly half the U.S. freight rail market, and citing a filing by 23 Democratic senators urging rigorous Surface Transportation Board review [2].
