Herndon lost its courtroom fight with Comstock, and it's not hiding the frustration. A Fairfax County Circuit Court judge granted summary judgment against the town in its bid to reclaim a nearly 5-acre downtown site after the developer walked away from a stalled mixed-use project in 2024. The judge ruled a 2020 deed amendment gave Comstock the upper hand; town officials called themselves "stunned and disappointed." FFXnow

Chip City pulled out of Virginia entirely. The New York cookie chain shuttered its Clarendon, Shirlington, and Tysons Corner locations, part of a national contraction that has closed sites in Connecticut and Massachusetts too. Arlington's real estate market has cooled, and this slowdown hits differently than 2022. Realtor Eli Tucker writes that mortgage rates climbing since July, rapidly in September, have slowed showings and stretched out sale times. The 2022 rate shock hit a market with fierce demand and little inventory; the 2026 market, he argues, went in with far less cushion. ARLnow

Herndon spent last year in court trying to claw back a downtown block, and lost on the fine print of a five-year-old deed. It is the quiet lesson under the week's development churn: out here the shovels and lawsuits both hinge on language nobody read closely enough at the time.
That's the briefing. Look out for each other out there. See you tomorrow.
