CNN, MSNBC, Politico Sue White House After Trump Bans Outlets From Press Coverage
nbcnews.com | cnn.com

CNN, MSNBC and Politico are preparing a First Amendment lawsuit against the Trump administration after President Donald Trump announced Friday that he was banning the three news organizations from the White House. Reporters from all three outlets were turned away at White House security kiosks Saturday and had their credentials revoked. Trump announced the ban on his Truth Social platform, citing what he called "constant" reporting of "FAKE NEWS" and warning that other outlets could face similar action.

The dispute escalated Sunday night when the White House removed CNN from its scheduled role as the primary television pool representative for the entire White House press corps on Monday, breaking with decades of established precedent. Under a long-standing arrangement, ABC, CBS, CNN, NBC and Fox News rotate the television pool responsibility, with a single crew supplying footage used by news organizations worldwide. The White House's Sunday scheduling email omitted any primary TV network and instead listed Real America's Voice, a small pro-Trump outlet, as the secondary crew for Trump's trip to New York for the United Nations General Assembly.

Sen. John Barrasso, R-Wyo., appearing Sunday on NBC's "Meet the Press," declined to say whether the ban violated the First Amendment, instead arguing that "the press has an obligation to report fairly." Barrasso drew a comparison to Trump's own prior bans from Twitter and Facebook, saying, "I didn't see people come to his defense," and added that he did not believe the controversy would affect Republicans in the midterm elections 44 days away. Gabe Rottman, vice president of policy for the Reporters Committee for Freedom of the Press, said flatly the ban was not legal.

The removal of CNN from the television pool carries consequences well beyond CNN's own newsroom, as pool footage serves as the primary means by which the public and media worldwide see the president during limited-access events and travel. It remains unclear how the other four major networks will respond to CNN's exclusion or how pool coverage will be handled during Trump's New York trip. Media critics have called on the networks to show public solidarity with the banned outlets as the legal challenge moves forward.
