CFTC Goes Solo on Crypto Rules as Congress Stalls | ethereum.miami

The CFTC sent a prerule on crypto asset transactions and markets to the White House for review on Friday, signaling the commodities regulator will build a derivatives framework under its own authority. The move comes days after the Senate failed to advance the CLARITY Act, which would have drawn cleaner jurisdictional lines between the CFTC and SEC. Washington's legislative gridlock, it turns out, is not the same as regulatory paralysis.

ETH climbed 5.08% to $2,639, riding a broad crypto rally that saw Bitcoin blast past $80,000 in a single session. Market cap reached $322.2 billion on $21.6 billion in 24-hour volume.

Regulators Fill the Vacuum

The CFTC's prerule submission to the Office of Management and Budget is the clearest signal yet that the agency intends to write crypto market rules without waiting for Congress. The CLARITY Act, which would have classified most major tokens as commodities and granted the CFTC primary oversight, collapsed in the Senate earlier this week. Rather than wait for another legislative attempt, the regulator is using existing Commodity Exchange Act authority to stake its claim.

The SEC is moving in parallel. The securities regulator opened a new pathway for tokenized stock trading the same week, a coordinated push that suggests both agencies have concluded that a comprehensive congressional framework is not coming soon. Crypto-linked equities, including Coinbase and Strategy, rallied on Friday after the initial CLARITY Act selloff, interpreting the regulatory action as constructive rather than threatening.

Coinbase Pushes Into Stock Perps

Coinbase filed with the CFTC to list perpetual futures contracts on individual stocks, starting with Apple, Tesla, and Nvidia. The contracts would give U.S. traders 24/5 leveraged exposure to single equities without requiring ownership of the underlying shares. The filing needs CFTC approval before trading can begin.

The timing is deliberate. With the CFTC actively building a crypto derivatives framework, Coinbase is positioning single-stock perpetual futures as a product that fits squarely within the agency's jurisdiction. Perpetual futures are already a dominant instrument on offshore exchanges and on platforms like Hyperliquid, which rallied alongside Solana on Friday as markets recovered from the CLARITY setback. Bringing them onshore and applying them to equities represents a direct challenge to traditional brokerage models.

The opposite scenario, a restrictive framework, would push activity back offshore and to competing hubs. For now, the market's reaction (crypto stocks rallying, ETH up 5%) suggests the bet is on the constructive outcome.
