New York issues first statewide moratorium on hyperscale data centers

Governor Kathy Hochul signed an executive order pausing state environmental permits for up to a year on new data centers using 50 megawatts or more of power, making New York the first US state to freeze hyperscale development. The order is meant to give the state time to build a regulatory framework addressing grid strain, ratepayer costs, water use, and noise before more AI infrastructure gets approved.

Why it matters

The open-source model startup, founded by former Google DeepMind researchers, locked in more than $1 billion in Nvidia-backed computing capacity from Nebius, adding to a June deal with SpaceX reportedly worth about $150 million a month through 2029. The moves reflect how smaller labs are racing to secure compute as demand continues to outpace data-center supply.
