New York Health Policy Monitor (June 30, 2026)
The Department of Health adopted new nursing home administrator standards, while the legislature struck key substance use disorder measures.
On June 24, 2026, the Department of Health finalized regulatory changes updating the definitions and approval standards for nursing home administration licensure. Long-term care operators must now align their administrative credentialing and hiring protocols with the newly codified frameworks. This formal adoption ensures that all operational personnel within residential care facilities adhere to standardized oversight requirements.
Separately, the Department of Health issued a proposed rule to modify organ donation consent protocols across the state. If finalized, the measure would explicitly allow close friends to authorize anatomical gifts on behalf of patients. Furthermore, the proposed rule seeks to expand transplant access by permitting individuals to register on multiple transplant waitlists simultaneously.
In legislative developments, lawmakers formally struck two notable behavioral health measures on June 22, 2026. Assembly Bill A10781 would have mandated the replacement of terminology related to addiction with person-first language across state statutes and facility documentation. Similarly, Assembly Bill A8830 would have required the state to procure and distribute advanced opioid and fentanyl rescue kits, equipped with internet connectivity and expiration alerts, to educational institutions.
